Gideon is African and Kaitlyn is Caucasian; their marriage informs her studio practice, primarily collage and textile work. “Navigating Race and Ethnicity” is an ongoing series of paper collages depicting their daily interactions. The slow process of paper cut-outs allows ample time for self-reflection on her experiences of being in an interracial relationship. Some of the memories mulled over are pleasant, while others leave her feeling uncomfortable. Perhaps this is also true for the viewer. Because paper is something that many people have been familiar with since childhood, the material and simple renderings provide an approachable aesthetic to a complex subject. The mundanity of one image generates widely different reactions from viewers. Her goal is creating art that contributes to the dialogue on race and identity, and encourages others—whatever their background—to consider their history and experiences.

Our big take away was that Portland still looks strong and could remain stronger than many other parts of the country. The big highlight? HIPSTURBIA – hipster havens in the suburbs around Portland. Places like Beaverton, Milwaukie and Oregon City. Why? Lots of reasons!!! Properties are less expensive than the inner city, so buyers get more bang for their buck. Pro Tip: The Art of Throwing Big Parties in Small Spaces

With the holidays fast approaching, we’re also entering peak party-hosting season. If you’re one of the many Portlanders living in an apartment or small home, you might find yourself feeling limited by your space. With some creativity and forethought, you too can master the art of throwing big parties in small spaces.

 

TIP #1: Make the Menu Work for You

Living in a smaller home means you likely have limited kitchen space. To keep your big night on-track, be sure to have your menu planned well in advance. In doing so, try to create dishes that don’t need to be served immediately. Plan on preparing your sides ahead of time instead. This will allow you enough time to clean up the dishes before your guests arrive, which will reduce clutter in your space and expedite the after-party sweep.

 

TIP #2: Don’t be Afraid to Rearrange

If you’re feeling restricted by your home’s layout, get creative. For instance, if your living room is more spacious than your dining area, temporarily rearrange your set up in the living space to better accommodate your guests. You can also remove larger pieces of furniture, storing them in out of the way for the evening. It’s only temporary, afterall!

 

TIP #3: Set up a Self-Serve Station

Another space-optimizing strategy is to have a buffet-style layout. This approach will streamline set up and frees up additional space on your table.

 

TIP #4: Get Eclectic!

A beautifully unique blend of paper cutting, painting, and mixed media, Kim Hamblin’s art is termed cut paper assemblage. The therapeutic process consists of cutting the paper to the desired shape, then painting, layering, glueing, pressing, and finally founding them to plywood with tiny nails, repeating the process for each piece of paper. Once the piece is assembled, a clear coat goes on top, followed by a frame. Kim’s art is influenced by her collection of old books, nature, and life, with images relating to the sciences of anatomy, botany, entomology, and zoology.

Portland’s Concordia neighborhood, situated north of Alameda and Beaumont-Wilshire, is one of the most desirable boroughs in the city’s Northeast quadrant. This rapidly growing area earned its name from Concordia University, a private liberal arts school located in the heart of the district. With nearly 3,800 households and an occupancy rate of 96%, Concordia is home to approximately 10,000 residents. As of 2019, Portland Monthly calculates the average home sale price at $535,783, which has increased from $518,304 since 2018.

The 411 on STRs (short term rentals)!

Interested in making part of your property into a short term or vacation rental via Airbnb or VRBO? We have a great new connection for you! See Melissa’s update below and find out what’s happening NOW in the world of short term rentals in Portland:

On July 30, 2014, Portland City Council passed an ordinance to allow short term rentals (STR) in Portland’s residential zones so long as the operators followed City code and obtained proper permitting. Since that time, only about 20% of STR operators have complied. Until now, enforcement has been complaint based only; meaning that a neighbor or affected party would have to call the City enforcement program to report an un-permitted host. 

In June 2019, Portland City Council passed an ordinance to remove any un-permitted STR listings posted on Airbnb and HomeAway/VRBO. After a lengthy lawsuit, the two booking platforms agreed to work with the City to allow only properly permitted hosts to post listings on their sites. HomeAway/VRBO will simply remove any listings that don’t have the proper permit number by September 30th 2019. Airbnb has created a “pass-through” system where hosts can obtain permits through the Airbnb website. The “pass-through” permit system will go live November 1st 2019. Hosts that have not obtained a permit through Portland’s Bureau of Development Services or by signing up for the “pass-through” will be removed as of January 1st, 2020.

Airbnb has agreed to share its hosts’ data with the City of Portland. This means the City will now have the name, mailing address, email address, phone number and rental address of all of the listing owners, as well as the number of bedrooms rented, the number of guests advertised for rent, the listing type (entire house, private room or shared room), the listing description and URL, the number of reservations, as well as actual dates booked and financial details. This will allow the City to enforce rules regarding the number of rooms and guests. Those who are out of compliance will be fined.

Airbnb hosts that are compliant with Type-A ASTR (Accessory Short Term Rental) permitting parameters will have nothing to worry about as they will be able to use Airbnb’s online permitting system. Any hosts that are outside of the Type-A ASTR allowances, will be removed. 

The Type-A ASTR  designation allows for two guest bedrooms to be rented to a maximum of five short term guests, and there must be at least one long-term resident living in the home full time. All hosts that rent more than two bedrooms must apply for the Type-B ASTR permit. They will NOT be allowed to use Airbnb’s online “pass-through” system. The Type-B ASTR permit allows for 3-5 bedrooms to be rented to short term guests with a maximum of two guests per bedroom. This type of permit is a Type-II Land Use Review and is a lengthy, expensive and bureaucratic process.

Melissa Wright of Short Term Rental Permits can help homeowners gain City approval for  both Type A and Type-B permits. Melissa can guide STR operators through the Type A process whether through the Airbnb site or the Bureau of Development Services. As far as Type B permits are concerned, Melissa knows exactly how to navigate the Title 33 Planning and Zoning Codes for STRs, and how to gain approval from the City of Portland for this type of Land Use Review. She has a 100% success rate at getting these approved!

Back to School Routines

The kids are back to school and feeding them is an ever present thought on the minds of parents! Last year we wrote about how to keep it simple, and this year we offer a few new concepts: Keeping it healthy and getting your kids involved in packing lunch. Lunch doesn’t have to be a main course and side dish affair, in fact the more kids we talk to, the more we hear that finger food and a variety of snacks is a favorite at lunch time. Try to include a healthy protein, 2 veg, or a veg and a fruit, and don’t forget the raw fuel of carbs! Those kids burn it off! If you can steer clear of sugar and refined carbs–that is always a plus. Have your kids pick out the fruit and veg from the produce section of the grocery store that they want to eat that week. If they’re older, they can cut produce and store it so it’s easy to grab throughout the week. If you have an even older kid…they can take over the prep and packing. Good times! Sweat equity is the resources of time, energy, ingenuity, creativity and personal labor that a homeowner pours into his or her property. Homeowners put sweat equity toward the projects to improve the value of their residence and enhance their quality of life while they live there. It includes landscaping, cleaning, painting and renovation projects. The Market in Focus: Removing Private Mortgage Insurance

Removing Private Mortgage Insurance – The Latest Changes from Fannie Mae

As first time homebuyers re-entered the market after 2009, the percentage of mortgages with mortgage insurance increased. Mortgage insurance is an additional monthly cost that offsets the lender’s risk with down payments under 20%. Effectively, the mortgage insurance fills in the gap if the buyers’ down payment isn’t enough to protect the bank. If the lender forecloses and takes a loss through the foreclosure sale, they can make a claim on the mortgage insurance policy to offset their loss.

On conventional loans, borrowers can remove private mortgage insurance costs without refinancing. It’s a significant advantage versus FHA financing, where the mortgage insurance stays on for the life of the loan. Also, removing private mortgage insurance is typically much less costly than refinancing, and available even if interest rates are higher. However, the procedure for removing it has been unclear and not necessarily standardized across all lenders/loan servicers. In June, Fannie Mae published guidance for mortgage insurance removal.

If you’re currently paying private mortgage insurance on a conventional loan, take a look below. On all of the removal options, mortgage payments must be current and these procedures apply to owner-occupied homes.

Procedure for Automatic Termination of Conventional Mortgage Insurance – based on original value (78% rule)

  • Mortgage insurance must be automatically removed (no request necessary) on the date the principal balance is first scheduled to reach 78% of the original value of the property. For example:
    • Original purchase price of $400,000, mortgage insurance comes off when the loan balance reaches $312,000

Procedure for Borrower-Initiated Termination of Conventional Mortgage Insurance – based on original value (80% rule)

  • The borrower must initiate the request for removal
  • The lender must verify the value has not declined, using Fannie Mae’s servicing system or an appraisal
  • If the above criteria are satisfied mortgage insurance must be removed (no request necessary) on the date the principal balance is first scheduled to reach 80% of the original value of the property. For example:
    • Original purchase price of $400,000, mortgage insurance comes off via written request the loan balance reaches $320,000

The above have been pretty standard across the industry, but also less common. With values rising quickly, most borrowers would like to know how to use the new appraised value to document sufficient equity to remove mortgage insurance versus paying the mortgage down. Fannie’s new release clarifies the process that all servicers must use.

Procedure for Borrower-Initiated Termination of Conventional Mortgage Insurance – based on new market value

  • The borrower must initiate the request for removal
  • Must verify value via an appraisal or Broker Price Opinion, ordered through the loan servicer
  • The mortgage must have been in place for 24 months
    • If the mortgage has been in place for 61 months or more, the loan to value ratio must be under 75%
    • If the mortgage has been in place 25-60 months, the loan to value ratio must be under 80%

The typical cost of a Broker Price Opinion or appraisal is $250 – $450, so if you meet the above criteria, it can be a real value proposition to remove the mortgage insurance and lower your monthly payment.

Pro Tip: How to Protect Your Home from Fourth of July Safety Hazards

Let the countdown begin! There are only two days left before Independence Day. This summertime celebration is synonymous with cookouts, fireworks and water activities, but it also holds the sinister title as the deadliest holiday in America. Now that we have your attention, let’s review some of the top Fourth of July safety hazards so that you and your family can have a safe holiday that is memorable for all the right reasons.

FIRE SAFETY

Fireworks are a staple of any July 4th celebration, but more fires are reported on this day than any other. Here are some key ways to ensure you enjoy recreational fireworks safely:

  • Only light fireworks in an open space, away from your home or any flammable foliage.
  • Be sure you have immediate access to water, either by bringing a bucket or having a hose on hand.
  • Don’t attempt to relight defective fireworks.
  • Ensure all children are closely supervised when handling matches, sparklers, or flammable materials.
  • Before disposing of fireworks, dump them into a bucket of water to ensure they are fully extinguished.
  • Double-check your smoke detectors before lighting fireworks.
  • Check the fire hazard danger level in your area to make sure it’s safe to light fireworks.

GRILL SAFETY

This holiday is also one of the most popular days for grilling. If you have a cookout planned, be aware of the following safety precautions:

  • Grills should be kept 10 feet from your home, off of decks and patios and away from flammable brush.
  • Keep a fire extinguisher on hand, should a grease fire occur.
  • Designate a grill master who will ensure the grill is monitored at all times.
  • Be sure you have lighter fluid on hand, and don’t use gasoline to ignite your grill.
  • Once you’re done, let coals cool for 48 hours, then wrap them in aluminum foil before disposing.

YARD & PET SECURITY

Humans aren’t the only ones at-risk during this holiday. Fireworks are particularly triggering to dogs and cats, who may try and escape once the celebration begins. For pet owners, protect your furry friends from Fourth of July safety hazards by taking these precautions:

  • Double-check the security of your fence. Fix or cover any gaps in your fence to prevent your pet from getting loose.
  • Know that a fence may not enough to keep your animals from escaping during fireworks. When feeling threatened, dogs will often dig underneath fences to seek refuge.
  • Don’t leave fireworks around your yard. They may be a future fire hazard, or potential health hazard for your pet.

Portland Visit

We often go out to visit our clients, but look who came to visit us! We sold these very special clients their house in close in NE in 2016. But then just one year later in 2017 the family needed to relocate to California. We sold their house in a snap and got them on their way to their new home in California. Shop Talk Vol. 11: The Street Tree Laws Portland Homeowners Should Know

We recently had an inquiry from a client who was dealing with a vandalized fruit tree in front of her home. Because the tree was located along the street, this brought up some interesting points regarding citywide tree laws. When it comes to planting, repairing or removing any tree in the City right-of-way, there are street tree laws Portland homeowners need to know.

PLANTING TREES

In order to legally plant a tree on a city street, you must first obtain a permit. You can submit the online Street Tree Permit Application, or request a paper permit application by calling 503-823-8733. The planting permit is free, takes under 10 business days to secure and includes a complimentary inspection. Set up your inspection prior to purchasing your tree by calling Urban Forestry at 503-823-4489.

You can also work with non-profit Friends of Trees, which partners with the City to facilitate street tree planting processes. When you purchase trees through their program, they work on your behalf to secure the required permits.

You can find a list of approved street trees at the bottom of this page, and the city mandated street tree standards can be found here.

PRUNING TREES

A pruning permit must be procured to prune any branch on a street tree with a base exceeding a ½ inch in diameter. In some instances, pruning permits can be obtained directly online. The criteria below outline instances where an application must first be submitted to Urban Forestry, as sourced from the city’s website:

  • The tree is at a non-residential property
  • Pruning is for crown restoration, weight reduction, clearing infrastructure such as buildings or utility lines, or crown reduction
  • Pruning is for branches greater than 6″ in diameter
  • The street tree is a Heritage Tree

REMOVING TREES

When it comes to removing destructive or undesirable tree from a City right-of-way, permits are required for all plants exceeding a ½ inch in diameter. Additional permits may be required if the property is in a regulated overlay zone or plan district. Restrictions may also be enforced to help protect environmentally sensitive or historic areas. Staff will let the applicant know when additional regulations apply to the property and will describe the permit requirements. To learn more about removal and replanting street tree laws, Portland homeowners, should review the FAQ list on the city’s website. For information on emergency tree removal, review this page.

PENALTIES & FEES

When it comes to dealing with city property and street tree laws, Portland, homeowners are better off erring on the side of caution. When planting, pruning or removing trees without the proper permits, you could incur costly fees. These penalties range in cost significantly, with the potential to exceed several thousands of dollars.

On April 10th Aryne + Dulcinea participated in the first ever ADU Roundtable hosted by Consolidated Community Credit Union. Rehab Ready—Part TWO

I stopped by to see progress being made on our client’s rehab project at the Philadelphia treatment centers. They have cleaned out the crawl space, put new vapor barrier, insulation, and cleaned up plumbing and electrical.  On the main floor there is new paint and flooring throughout, and the kitchen has been brought back to life with repairs, paint, and pulls. Across Oregon, and the Portland market in particular, there has been a wave of rising home values and declining affordability. Buyers face more challenges in qualifying, and higher mortgage payments are testing buyers’ monthly budgets. As in the past, lenders are coming up with non-traditional mortgages & lending solutions designed to help buyers qualify for more home, even if their tax returns or verifiable income do not support the mortgage payment. It should be noted that these programs to not help the buyers make the payment, just qualify for the larger mortgage. Sounds a lot like 2005, doesn’t it?

Currently, these mortgages represent a very small percentage of the total mortgages originated. They are also reported differently to regulators and subject to greater scrutiny. Although financial memories tend to be short, it seems unlikely that these loan products will lead to any type of 2008-style meltdown. They just aren’t that prevalent and are unlikely to become so. What’s more likely is that individual consumers will be harmed – and likely the most vulnerable. There’s a saying in financial circles that “rich people don’t buy lottery tickets.” That means that the folks taking the most risk are typically those that can least afford it.

In addition to the mortgage types mentioned above, there is a new product that claims to actually help homebuyers borrow more with a lower monthly payment. If you have a lot of equity in your home, you’ve likely received multiple mail solicitations offering a payout or “investment” in return for sharing in your home’s appreciation when you sell.  Typically, the “investor” is offering a cash payout of 10% – 25% of the value of your home and no monthly payment is required. That would put $25,000 – $60,000 in the pocket of the homeowner with no change in monthly cash flow. Because the payout is considered an investment in return for partial ownership rather than a loan, the transaction is not subject to the standard mortgage disclosures that protect consumers. I’ve read the actual paperwork and it is confusing.

No monthly payments sounds awesome. It should not be assumed that just because there are no monthly payments that this product is a low cost source of funds. The investor is repaid with a percentage of the value increase when the home is sold and shares in any loss if the value declines (subject to caveats). It’s typically 30-70% of the appreciation, which could make the effective annual cost as high as 20%. If my Dad wrote this article, he would say something like: “The time you pay the most is when you think you’re getting something for free.”

One of the only positive byproducts of the financial crisis was the standardization of mortgage products. Lenders are required to make sure that borrowers can pay back the mortgage and prepayment penalties are nearly outlawed. This has made it easier for borrowers to avoid catastrophic errors. As the market changes and non-traditional mortgages & lending options become more complex, it is important to make sure you understand everything you sign. Seek counsel from professionals you respect and choose a lender you know and trust. And if you get an offer that seems too good to be true – remember what my Dad says – it probably is.

Shop Talk Vol. 10: How to Create a Your Own Backyard Bee Haven

According to statistics from the U.S. Department of Agriculture, bees are responsible for pollinating approximately one-third of the food we consume. Accounting for the pollination of 80% of flowering crops, bees play an essential role in our everyday lives. Despite the critical services bees provide, their populations continue to dwindle, putting our nation’s food supply at risk. Fortunately, you don’t need to be an accomplish beekeeper to help the species. Using these three tips, you can create effectively transform your outdoor space into a backyard bee haven!

 

Tip #1: Be Wild

A yard that is highly-maintained may be less appealing to these critters, so don’t be afraid to loosen the reigns a bit. The best source of nectar tends to be the wildflowers that are native to your region. Allow patches of wildflowers to grow undisturbed in to achieve increase of pollinator traffic your space. By letting your grass grow a little longer and – gasp– allowing a few weeds to take root (dandelions, clover, chickweed), you’ll be creating a source of pollen and nectar for bees to enjoy during the offseason.

 

Tip #2: Plant Strategically

When selecting plants for your outdoor space, there are a few factors to consider if you want to create your own backyard bee haven. In general, bees tend to be attracted to flowers that are blue, yellow and purple. Plants that have flat blossoms are a favorite for bees, as they provide more direct access to pollen and nectar. If you have questions about plant selection, visit your local plant store to find out what varieties attract the most bees in your region.

 

Tip #3: Create a Habitat

Many types of bees are known to stay close to their homes, generally travelling only 300-feet from their nest. With that in mind, creating nesting sites within your property will greatly increase accessibility for bee populations. Some methods of promoting bee habitation include setting up a manufactured or handmade bee homes, and providing a bee bath or other water source. These factors will encourage your bee friends to settle into your yard.

By making these changes, you be able to create a flourishing backyard bee haven. In doing so, you’ll also be working to promote to the health and sustainability of bee populations. Additionally, your garden will reap the wondrous benefits of additional pollination.

The legacy of Portland’s historic Laurelhurst neighborhood began in 1850, when Congress passed the Donation Land Claim. This statute encouraged European immigrants to migrate west, providing a powerful incentive which granted eligible populations ownership of up to 640 acres of land. A Perfect Day in Portland’s Overlook Neighborhood

Portland’s Overlook neighborhood is aptly named, peeking out at the Willamette River from the bluffs of the Northern Peninsula. The area was partially settled in the 1800s as part of the former city of Albina. Significant development began in the early 1900s, when the streetcar lines and roads began expanding toward St. Johns. Since this time, Portland’s Overlook neighborhood has been subject to major transformations, serving as the home of the city’s first airport and undergoing extensive redevelopment to accommodate the creation of the I-5 freeway.

Central to this this area is the thriving Interstate Avenue, which features the city’s northern-bound MAX line. The train is a great connecting point to the neighborhood’s many features. To start of your day, we recommend stopping by The Eisenhower Bagelhouse. Here, you’ll find a gourmet selection of boiled bagels, which are hand-pulled on-site for your viewing pleasure. Enjoy the bagel in-house, put take your beverages to-go. Moving westward along N Going Street will bring you to a chain of impressive lookouts, including Mocks Crest and Overlook Park. AFTERNOON

Resting at the bottom the bluffs is Swan Island, a shipyard and primarily industrial area with a surprisingly charming beach area. It might seem out of the way, but on weekends, when McCarthy Park is free from the commuter traffic, the area is surprisingly serene and grants unobstructed views of the river winding through the Fremont bridge.

You can enjoy a bite to eat on Swan Island, as locally-owned Tilt offers intimidating sandwiches during lunch hours. Heading back to the central area of Portland’s Overlook neighborhood, you may also enjoy stopping by the renowned Fire on the Mountain for mouth-watering wings. (Even vegans will be satisfied with their inventive wing menu.)

Another standout in Portland’s Overlook neighborhood is the Interstate Firehouse Cultural Center, a community arts center located founded by Portland’s first African-American elected official, Commissioner Charles Jordan. Converted from a 1910 fire station, the structure now offers a wide range of activities in its theater, art gallery, and dance studio.

The Market In Focus: New Rules for Removing Mortgage Insurance

If you took a conventional mortgage out over two years ago and put less than 20% down – it could be a great time to look at lowering your mortgage payment by removing mortgage insurance. Mortgage insurance is in place to protect banks against loss should a mortgage go unpaid. Twenty-percent equity is typically required as a cushion in case of default, and mortgage insurances serves to make up the difference in cases of smaller down payments. This additional cost increases the overall monthly mortgage payment.

Historically, homeowners have removed mortgage insurance and lowered their monthly payments refinancing. Unfortunately, interest rates have risen over the last twelve months, making refinancing less cost-effective. The good news is that conventional mortgages allow homeowners to remove mortgage insurance without refinancing. They can deal directly with their current loan servicer and follow an administrative process to eliminate the monthly cost.

The challenge is that, while there were general guidelines that most banks followed, the requirements and method for removing mortgage insurance varied. If a mortgage loan was sold or transferred, the terms for taking off the mortgage insurance could change, making it difficult for lenders and homebuyers to plan for future removal. Fortunately, Fannie Mae developed rules for mortgage insurance removal which will apply across all loan servicers. These rules should make it easier for homeowners to reliably determine when they can lower their monthly payments.

Here are three ways for effectively removing mortgage insurance, assuming on-time payments for 24 months:

Automatic Termination – when the mortgage is paid down to 78% of the original value

  • If a homeowner pays his/her note down to 78% of the original value, the mortgage insurance terminates with no action required by the homeowner.
  • No fee can be charged by the servicer and the mortgage insurance must be removed on the date the principal balance of the mortgage loan is first scheduled to reach 78% of the original value of the property.

Requested Mortgage Insurance Termination Based on Original Value – when the mortgage is paid down to 80% of the original value

  • Once the principal balance reaches 80% of the original value of the property, the homeowner can request termination of the mortgage insurance – it doesn’t happen automatically.
  • The servicer is required to run the property through Fannie Mae’s Automated Valuation Model to confirm the value hasn’t declined. If the AVM doesn’t confirm the original value, the homeowner can order an appraisal through the servicer to confirm the value is the same or higher than when the loan was originally taken out.

Requested Mortgage Insurance Termination Based on Current Value – using an increase in appraised value.

  • Now it gets tricky. The biggest change is the quantification of how long the mortgage must be in place before a value increase can be used to remove mortgage insurance.
  • Homeowners can’t use market appreciation until a two-year payment history has been established.
  • If the mortgage has been in place less than two years, the increase in value must be supported by documentation of improvements.
  • If the mortgage has been in place between two and five years, the appraisal must document that the mortgage is no more than 75% of the appraised value.
  • If the mortgage has been in place over five years, the appraisal must document that the mortgage is no more than 75% of the appraised value.

With the way Portland values have risen in the last five years, it’s a great time to look at removing mortgage insurance to lower your mortgage payment. If any of the above scenarios fit your situation, reach out to your current mortgage servicer and ask them to send you their written procedure for its removal. Shop Talk, Vol. 9: Do You Know If Your Chimney is Santa-Safe?

Christmas is no small operation – it takes the Guy in Red an entire year to orchestrate. After all that effort, it’s common courtesy to ensure his point of entry is up to par. In doing so, you’ll also be keeping your home and your family safe from the many potential hazards of a neglected chimney. Don’t end up on next year’s naughty list; be sure that your chimney is Santa-safe.

It comes each time this year! We are of course talking about your annual chimney inspection, which identifies any build-up of creosote, a combustible tar-like substance responsible for many chimney fires. An inspection can evaluate the level of soot and creosote accumulation in the structure. Annual chimney maintenance involves removing these flammable by-products, thereby extending the lifespan and security of your home’s chimney.

These hazards are the cause of many home fires, many of which go unnoticed. The Chimney Safety Institute of America (CSIA) reports,

Slow-burning chimney fires don’t get enough air or have fuel to be dramatic or visible and they often go undetected until a later chimney inspection, but, the temperatures they reach are very high and can cause as much damage to the chimney structure – and nearby combustible parts of the house – as their more spectacular cousins.

Another factor to be extremely cautious of is carbon monoxide. When the damper in the fireplace is not fully open, smoky air containing carbon monoxide can move throughout the house. Colorless and odorless, the deadly gas goes undetected without the proper equipment. Be sure you have multiple detectors throughout the house, especially in areas in close proximity to the fireplace.

While you’re getting your fireplace cleaned, also have your professional take a look at your flue. Though typically less of a concern than the chimney itself, the flue can still collect creosote over time. With annual chimney inspections and maintenance, you can rest assured that your home is free from these life-threatening hazards. And when your chimney is Santa-safe for the Christmas crew, you might just make it on to their VIP-list.

The Market In Focus: Cycle of Real Estate and FHA Financing – are we primed for a change?

If you talk to Portland real estate agents these days, most will tell you we are seeing a sea change in the market. Buyers are pickier, listings are sitting longer and more transactions are terminating after inspections. Of course, some if this is completely normal – homes don’t typically sell in three days for full price. So what is the relationship between the cycle real estate and FHA Financing? With a rise in marketing times, inventory and FHA financing, the real estate cycle will likely experience a slowdown.

We’ve had an amazingly robust market, with Portland’s median price up over 45 percent from the bottom 8-10 years ago. It’s been a run fueled by strong economic growth, Portland’s livability and position as one of the more affordable west coast cities. The increased values were also supported by gradually loosening mortgage underwriting criteria that made it easier for homebuyers to get mortgages. Now, these looser criteria were nothing like what we saw in the early 2000’s. Income, assets and credit were all verified and loans originated from 2010 to today are performing very well.

What accounts for the market slowing, then? Is this a warning sign? Home prices have risen faster than incomes. In conjunction with higher interest rates, that makes homes less affordable. It’s just harder to buy a home with a comfortable monthly payment than it was 5 or 6 years ago. Much of the pool of well-qualified buyers already bought in the last eight years. There are fewer buyers, and those that remain often have higher debt to income ratios and lower credit scores. Overall credit quality is down and Fannie Mae and Freddie Mac are beginning to tighten up their guidelines to lower risk. Because it’s easier to qualify for an FHA mortgage, more buyers are using FHA financing. Here’s where there are some similarities with 2008; the rise in FHA loans was dramatic when the housing market cratered. Currently, FHA originations are 20% of new loans issued, vs the historical average of 9%.

Fannie Mae and Freddie Mac are chartered differently than FHA. They are tasked with providing liquidity, whereas FHA is chartered to raise the level of homeownership.  That means FHA is supposed to do riskier loans. They are supposed to step in and make loans when other entities will not. Nowhere was this more evident than when the bubble burst. FHA mortgages went from 3% of new purchase loans issued in 2007 to 28% of the market in 2009. FHA did exactly what they were supposed to do – when lenders were reluctant to originate new mortgages, FHA provided the guarantee that kept the real estate market going. Of course, the dramatic rise in FHA loans occurred after the market had crashed, not before.

So – we have sales slowing, affordability declining and FHA’s market share rising. Does this mean that the market has peaked and that we’re looking at a repeat of 2009? It makes for exciting articles on the internet, but probably not. We are all subject to a preference for recency, and when it takes more than a week to sell a home, it’s easy to jump ahead and assume the market is ready for a “correction”. The likely answer is that sales and price activity are within a healthy band. Within that band there are mini peaks and valleys that do not necessarily represent the beginning of a long term trend. Watch inventory – we’re currently at 3.9 months, underneath the 4 month average in the “boom” years from 2000 – 2005. For perspective, inventories peaked at over 10% in 2008. When we see a rise in marketing times, an increase in inventory and a rise in FHA financing, it’s likely there’s a trough coming in the real estate cycle. For now, expect slow growth and some stagnancy as sellers adjust to a more balanced market. As interest rates rise slightly and price growth slows, we see the typical increase in all types of mortgage fraud. According to CoreLogic, aggregate fraud risk has risen each of the last six quarters. Outright forgery is still the most popular type of loan fraud. Occupancy fraud is next, followed by Identity theft.

Mortgage fraud typically rises in tandem with interest rates. Higher interest rates reduce the number of refinance transactions; they have a lower incidence of fraud. Purchase transactions are more likely to be fraudulent, buyers have an incentive to “push the envelope” as there’s more at stake. Higher interest rates and rising values also make qualification more difficult. Rising values bring in speculators hoping to buy and sell quickly for a profit.

This was especially true in the “boom” years of 2004-2006, when buyers wanted to buy as many properties as possible, for the largest profit. To buy more homes with less down payment, these buyers were guilty of occupancy-related mortgage fraud, using owner-occupied loans even though they had no intention of ever occupying them. These small down payment loans had higher monthly mortgage payments. When the market turned, the buyers were unable to make the payments and these speculative purchases were a high percentage of total foreclosures. Although these loans created enormous losses, there was very little enforcement. Often, it was challenging for lenders to access the data that would document the occupancy fraud and they frequently did not want to expose inadequate quality control policies that should have caught the fraud at application.

It will be interesting to see what enforcement looks like this time, when the market turns and defaults rise. Mortgage lenders, the FBI and the CFPB now have access to so much more data to document false applications. This has made identity theft and outright forgery much more difficult for fraudsters to execute. Lenders have sophisticated cross-referencing software that creates red flags when there are mismatches in identification data. However, because occupancy fraud is only committed after closing, it’s been more challenging for banks to track.

It’s now easy for banks to track and see if purchased home is occupied, referencing DMV records for change of address, utility bills, public record information for owner’s address, etc. If there are allegations of fraud or tax evasion, the IRS can share information about rental activity on Schedule E of the tax returns. This may create a different dynamic than in 2009, as a fraudulent application allows the lender to call the note due and begin foreclosure proceedings immediately, without having to follow the typical waiting periods.

Of course, when prices are rising and payments are being made, fraud is often concealed. When the market eventually turns and defaults rise, we’ll see whether lenders use anti-fraud tools to mitigate losses and collect more quickly. As Warren Buffett said, Only when the tide goes out do you discover who’s been swimming naked…

The Market in Focus: How Amazon and Zillow Mortgage Products May Impact Mortgage Prices

What’s new in the mortgage business in 2018? More of the upward cycle in homebuying and competition for mortgage borrowers like we haven’t seen since 2006. After 10 years of fragmentation, big players are entering the mortgage space. Zillow is rolling out a mortgage provider to go with its real estate arm. Additionally, there are likely rumors that Amazon is working to build its own mortgage platform. Questions abound about what disruption Amazon and Zillow mortgage products may bring.

Historically, mortgages have been among the most regulated financial products. The government acts as a mortgage purchaser (Fannie Mae and Freddie Mac) and as a mortgage insurer (FHA). Along with their support for the mortgage industry comes a very specific set of rules for how mortgages can be originated -– we call this compliance– and an arcane set of rules that determine who gets a mortgage or not – called guidelines.

The “guideline” portion of the mortgage business – how loans are approved – could change with the arrival of these new players. Amazon and Zillow have both made a business of predicting consumer behavior by aggregating and analyzing data. It isn’t a big stretch to imagine them using that type of analysis to develop their own set of metrics for approving loans.

Compare how car loans are originated to how mortgage loans are underwritten and approved. Car loans are typically based on verbal information, heavily credit-based and approved in minutes. The value of the collateral (the car) is determined automatically based on a database of actual sales. The automated underwriting system amalgamates the credit, income and collateral data and analyzes it with an algorithm to determine if the loan will be approved. There is a wide spectrum of terms offered, based on risk. “good” loans get lower interest rates, “risky” but approved loans get higher interest rates.

Mortgage loan approvals are rule-driven – has the borrower been self-employed for two years, is the down payment borrowed, etc. There’s a loose correlation between meeting standardized underwriting criteria and loan performance, but at a micro level, loan decisions are not made based on how “good” a loan is. They’re made based on whether the right boxes are checked. While terms vary somewhat based on credit score, for the most part it’s a pass/fail system. It’s all very 1970.

With these new players entering the market, it’s possible that the next wave of change in the mortgage business will be to integrate big data and change the way mortgage loans are approved and priced. Amazon and Zillow mortgage products could mean quicker, easier loan approvals for the consumer. There would be a wider range of terms that more accurately reflects overall risk and makes mortgages available to riskier borrowers. It’s been just about long enough since 2009 for to see the business cycle open to change. The mortgage business has been among the most resistant to change – but five years ago, who thought you’d get into a stranger’s car instead of a taxi?
